Terms and Conditions for Coaching Services

1. Introduction

These Terms and Conditions (“Agreement”) govern your use of coaching services provided by New Badass You, Inc. (“Company,” “We,” “Our”). By purchasing any of our coaching products, including 1:1 coaching sessions, long-term coaching containers, and associated course materials, you agree to be bound by the terms outlined below. These terms apply to all services provided by New Badass You, Inc.

2. Product Pricing

  • Pricing Changes: Prices for coaching sessions, packages, and courses are subject to change. The price you agree to at the time of booking will be locked in for that specific purchase. If you return to purchase additional sessions or products, the price may differ from your initial purchase.

  • Payment Plans: Payment plans are available for long-term coaching containers and will be locked in at the time of sign-up. All payments must be made as per the terms outlined in your specific coaching agreement.

3. Refunds and Cancellations

  • No Refunds: All sales are final. Once payment is made, no refunds will be issued under any circumstances.

  • Session Cancellations: If you need to cancel or reschedule a 1:1 coaching session, please provide at least 24 hours' notice. Sessions canceled with less than 24 hours' notice or missed without notice may be forfeited.

4. Confidentiality and Use of Client Content

  • Confidentiality: All information shared during 1:1 coaching sessions will remain confidential, unless disclosure is required by law or necessary to protect the safety of the Client or others.

  • Use of Content: Client agrees that while their personal 1:1 session content will never be publicly posted, anonymized examples or insights may be used for promotional or educational purposes. If you participate in any group sessions (available in the future), your content may be used in social media or marketing materials, unless you specify otherwise at the time.

5. Client Responsibilities

  • Active Participation: As a client, you are responsible for your own growth and progress. This includes fully participating in sessions, engaging with the provided materials, and completing any homework or exercises to the best of your ability.

  • Engagement: You agree to arrive prepared for each session and actively engage in the coaching process.

6. Disclaimer

  • Coaching vs. Therapy: Coaching services provided are not therapy, counseling, or medical advice. The Coach is not a licensed mental health provider, and coaching should not be used as a substitute for professional mental health or legal services.

  • No Guarantee of Results: While we strive to provide high-quality services, results may vary and are not guaranteed. Client is solely responsible for their outcomes. The Coach will guide, mentor, and provide tools and resources, but the actions and integration of the coaching work are the responsibility of the Client. The Client must actively engage with the material, follow through on assignments, and take personal responsibility for applying the insights and strategies discussed during sessions. The Coach cannot do the work for the Client. Success in coaching is a partnership, and progress depends on the Client’s commitment to their own transformation.responsible for their outcomes.

7. Intellectual Property

  • Ownership of Content: All coaching materials, resources, and course content provided are for personal use only. Clients are prohibited from copying, distributing, or using the materials for commercial purposes without express written permission from New Badass You, Inc.

8. Termination

  • Breach of Terms: Either party may terminate this Agreement in writing if the other party breaches any material terms and fails to resolve the issue within 5 business days. Termination will not result in a refund, and all outstanding payments will remain due.

9. Voxer and Additional Support

  • Voxer Access: Clients in long-term coaching containers will have access to Voxer for voice/text support between sessions. Voxer access is available during business hours (Monday to Friday, 9:00 AM to 5:00 PM), with a typical response time of up to 48 business hours.

  • Urgent Support: Voxer is not an emergency support system. Urgent issues requiring immediate attention should be addressed outside of Voxer, as immediate responses are not guaranteed.

10. Course Access

  • Course Access: Clients who purchase any long-term coaching container will receive access to the Unleash Your Limitless Energy course, which is sold as part of the coaching container. Course access will remain available as long as the client’s coaching package is active.

11. Dispute Resolution and Arbitration

  • Arbitration: Any disputes or claims arising out of or relating to this Agreement will be resolved by binding, individual arbitration under the rules of JAMS, Inc., and you waive the right to participate in a class action lawsuit or class-wide arbitration.

  • Governing Law: This Agreement is governed by the laws of the state of [Your State/Country], and disputes will be resolved in the courts of [Your Jurisdiction].

12. Miscellaneous

  • Amendments: We reserve the right to modify these Terms and Conditions at any time. Changes will be communicated to you, and your continued use of services will constitute acceptance of those changes.

  • Entire Agreement: This Agreement represents the entire agreement between the parties, superseding all prior communications and agreements.

By proceeding with booking any services or products, you acknowledge and agree to these Terms and Conditions.

Customization for Your Products:

  • For 1:1 Session: The terms related to payment, cancellations, and rescheduling apply directly to the single-session purchase.

  • For Long-Term Coaching Containers: Specific terms regarding course access, payment plans, and session usage (sessions must be used within the coaching period) are emphasized.

  • For Self-Paced Course: Since the course is bundled with the long-term coaching container, the terms regarding course access and usage will align with that package.
